The role of the Higher Electoral Court and its impact on the accountability relationship between the Legislative and Judiciary

The goal of this paper is to evaluate the implications of electoral justice activism in political-party competition by creating new law in this current republic. That is, although it is not within its competence, the TSE has been carrying out these functions, through new rules that, in turn, have implications both in the system of political representation, and in the relation of horizontal accountability and between the Powers of the Republic. We start from the premise that the model of electoral governance adopted in Brazil favors judicial activism through resolutions issued by the Superior Electoral Court, since such an independent and specialized model excludes political parties from managing the electoral process, making the production of consensus of political party competition is left to the TSE. Resolutions will be analyzed according to their origin, scope and political consequence in order to assess whether the Court has acted as a "legislative power" or have taken decisions of mere interpretive character in the light of the Federal Constitution. The hypothesis is that judicial activism of the Higher Electoral Court has been used as an instrument of horizontal accountability by the Judiciary, that is, control of the electoral and legislative action of the Executive and Legislative Branch, atypically by means of the creation of law in addition to its constitutional competence to regulate electoral matters.Coordenação de Aperfeiçoamento de Pessoal de Nível Superior (CAPES)O objetivo deste trabalho é avaliar as implicações do ativismo da Justiça Eleitoral na competição político-partidária ao criar direito novo nesta atual República sob a ótica da judicialização. Ou seja, embora não seja de sua competência, o TSE vem exercendo essas funções, por meio de novas regras que, por sua vez, tem implicações tanto no sistema de representação política, quanto na relação de accountability horizontal entre os Poderes da República. Partimos da premissa de que o modelo de governança eleitoral adotado no Brasil favorece o ativismo judicial por meio de resoluções expedidas pelo Tribunal Superior Eleitoral, uma vez que tal modelo independente e especializado exclui os partidos políticos do gerenciamento do processo eleitoral, fazendo que a produção de consenso da competição político-partidária fique a cargo do TSE. Serão analisadas resoluções de acordo com a sua origem, abrangência e consequência política afim de avaliar se o Tribunal tem agido como “poder legislativo” ou tomado decisões de mero caráter interpretativo à luz da Constituição Federal. A hipótese é a de que o ativismo judicial do Tribunal Superior Eleitoral tem sido utilizado como instrumento de accountability horizontal pelo Poder Judiciário, ou seja, de controle da atuação eleitoral e legislativa do Poder Executivo e Legislativo, de forma atípica por meio da criação de direito novo para além da sua competência constitucional de regulamentação sobre matéria eleitoral
