Jurisprudencia Española y Estadounidense acerca de la Protección Jurídica de los Videojuegos y su Originalidad

Video games make up the entertainment industry that has grown the most in recent years. Many companies, throughout its history, have generated a large number of works that are protected by intellectual property, either its audiovisual component, or the computer component that structures and directs the contents. Despite this, video games do not have a place in the respective Intellectual Property or Copyright laws of Spain or the United States. It has been the jurisprudence of both countries that has integrated them into one of the existing systems. In Spain, sentences have dealt almost exclusively with regard to piracy and the legitimacy of security measures for video games or game consoles. Meanwhile, in the United States there have also been such sentences, but at the same time they have ruled about their originality and limits of protection.Los videojuegos conforman la industria del entretenimiento que mayor crecimiento ha tenido durante los últimos años. Muchas compañías, a lo largo de su historia, han generado gran cantidad de obras que están protegidas por la propiedad intelectual, bien su componente audiovisual, bien el componente informático que estructura y dirige los contenidos. A pesar de esto, los videojuegos no tienen un lugar en las respectivas leyes de Propiedad Intelectual o Copyright de España o Estados Unidos. Ha sido la jurisprudencia de ambos países la que los ha integrado en alguno de los sistemas existentes. En España las sentencias han versado casi exclusivamente acerca de la piratería y la legitimidad de las medidas de seguridad de videojuegos o videoconsolas. Mientras, en Estados Unidos también se han dado este tipo de sentencias, pero a la vez han fallado acerca de su originalidad y límites de protección
