Acesso ao poder judiciário após a reforma trabalhista

The purpose of this research is to analyze whether, with the entry into force of Law 13467/17, entitled "Labor Reform, there was violation of the Federal Constitution of 1988, mitigating fundamental rights, and if there was an obstacle to citizen access to the Judiciary and order. In order to reach the goal outlined, in relation to the level, the research was used in an exploratory way, regarding the approach was used to qualitative, and regarding the procedure used to collect data, the bibliographic was applied. Through access to data obtained from the Secretariat of Social Communication of the Regional Labor Court (TRT) of the 12th Region (jurisdiction of the state of Santa Catarina) on the number of labor lawsuits filed before and after the advent of the " Labor Reform "it was possible to verify that the number of lawsuits has reduced considerably, considering that the parties are more afraid to activate the Judiciary, causing them to stop s eeking their rights and limiting the citizen's access to the Judiciary. It is concluded that some articles of the said Law were in line with the norms affirmed in the Federal Constitution and the rights guaranteed in international treaties to which Brazil is a signatory.Esta pesquisa tem por objetivo analisar se com a entrada em vigor da Lei nº 13.467/17, denominada “Reforma Trabalhista, houve infringência à Constituição Federal de 1988, mitigando direitos fundamentais, bem como se houve obstaculização ao acesso do cidadão ao Poder Judiciário e à ordem jurídica justa. Com o intuito de atingir o objetivo traçado, em relação ao nível, utilizou-se da pesquisa em caráter exploratório, quanto à abordagem foi utilizado a qualitativa, e no que tange ao procedimento utilizado para a coleta de dados, aplicou-se o bibliográfico. Por meio de acesso a dados obtidos junto à Secretaria de Comunicação Social do Tribunal Regional do Trabalho (TRT) da 12ª Região (Tribunal que tem como jurisdição o Estado de Santa Catarina) acerca do número de ações trabalhistas ajuizadas antes e após o advento da “Reforma Trabalhista” foi possível constatar que o número de demandas reduziu consideravelmente, tendo em vista que as partes estão mais receosas ao acionar o Poder Judiciário, fazendo com que deixem de buscar seus direitos e havendo uma limitação ao acesso do cidadão ao Poder Judiciário. Conclui-se ao fim que alguns artigos da referida Lei foram de encontro a normas positivadas na Constituição Federal e a direitos garantidos em tratados internacionais dos quais o Brasil é signatário
