Reforma trabalhista: justiça gratuita, honorários de sucumbência e efetividade do acesso à justiça

By the present scientific paper, it is intended to analyze the alterations due the implementation of law n. 13.467/2017, which performed significant changes on the Consolidation of Labor Laws, modifying the normative regency of the gratuitous justice and its concession on Labor Law Procedure. Moreover, it is proposed to examine the inovation introduced by article 791-A of CLT allowing the concession of succumbency fees. As from the raise of the risks due succumbency, the cost-benefit relation of the proposition of a lawsuit is modified, existing a real tendency of decrease of the proposition of lawsuits. With the purpose of cohibiting reckless lawsuits, it is concluded that this new juridic framework also possesses the propension of impeding the birth of lawsuits backed on legitimate rights. Therefore, the impact coming of Labor Law reform has to be evaluated, in order to respect the normative program estabilished by the 1988 Federal Constitution.Através do presente artigo científico, pretende-se analisar as alterações decorrentes da implementação da Lei 13.467/2017, que realizou significativas inovações na Consolidação das Leis do Trabalho, modificando a regência normativa do instituto da justiça gratuita e sua concessão no Direito Processual do Trabalho. Propõe-se, ainda, a examinar a alteração introduzida pelo artigo 791-A da CLT, permitindo a concessão de honorários de sucumbência. A partir da elevação dos riscos decorrentes da sucumbência, modifica-se a relação custo-benefício do ajuizamento de uma demanda, existindo uma tendência real de diminuição na propositura de ações. Com o propósito de coibir lides temerárias, observa-se que este novo arcabouço jurídico possui também a propensão de impedir o nascimento de processos lastreados em direitos legítimos. Logo, tal impacto advindo da Reforma Trabalhista precisa ser avaliado, a fim de que seja respeitado o programa normativo estipulado pela Constituição Federal de 1988
