Értekezésemben ítélkezés-elméleti vizsgálódásokat végzek. Az ítélkezés-elmélet a bírói döntés elméleti problémáival foglalkozik: a bírói, jogi gyakorlatban felmerülő jogalkalmazási problémák természetének megvilágításával és a problémák megoldására irányuló javaslattételekkel. Az alapvető probléma, melyet az értekezésben vizsgálok, a jogelméletben és a jogi gyakorlatban is sokat vitatott bírói formalizmus mibenléte és megítélése. Az úgynevezett jogi vagy bírói formalizmus általában a jogelméletben elsősorban kritikával illetett jogalkalmazási, érvelési stratégiának számít.
