La alineación parental como causa de variación de la tenencia

This research study investigates parental alienation and its manifestation in the tenure processes and the visitation regime as a problem that violates the fundamental rights of children and adolescents. These were not recognized recognized in the legal system of our country, reason why, we maintain, should be regulated as a cause of the change in tenure.For its development, a field work was carried out and 14 judges of the family courts of the Superior Court of cadres and pie charts were surveyed on the results obtained for their contrast and discussion. Also the analysis of the doctrine, the legislation and the national and international jurisprudence on the subjects related to this investigation was realized.The description of problematic reality and the theoretical framework on parental alienation, parental authority, tenure processes and the visitation regime, and the integral protection of the rights of the child (mainly the right to live with the family) . In the same way, the results obtained in the field work are contrasted and discussed. Finally, the conclusions and recommendations of the researcher are presented.The research methodology is descriptive and correlational. We must emphasize that this work does not aim at the subject of parental alienation, but a tool to help solve this problemEste trabajo de investigación estudia la alienación parental y su manifestación en los procesos de tenencia y régimen de visitas como un problema que vulnera los derechos fundamentales de los niños, las niñas y los adolescentes. Estos no se encuentran reconocidos en el ordenamiento jurídico de nuestro país, motivo por el cual, sostenemos, debe ser regulado como una causa de variación de la tenencia.Para su desarrollo, se realizó un trabajo de campo y se encuestó a 14 magistrados de los juzgados de familia de la Corte Superior de cuadros y gráficos circulares sobre los resultados obtenidos para su contrastación y discusión. También se efectuó el análisis de la doctrina, la legislación y la jurisprudencia nacional e internacional sobre los temas vinculados a esta investigación.Se presenta la descripción de la realidad problemática y el marco teórico sobre la alienación parental, la patria potestad, los procesos de tenencia y de régimen de visitas, y la protección integral de los derechos del niño (fundamentalmente, del derecho a vivir en familia). De igual manera, se contrastan y discuten los resultados obtenidos en el trabajo de campo. Por último, se ofrecen las conclusiones y recomendaciones del investigador.La metodología de investigación es descriptiva y correlacional. Debemos resaltar que este trabajo no pretende agotar el tema de la alienación parental, sino ser una herramienta de ayuda para la solución de este problema
