Entre los historiógrafos de la esclavitud africana y sus descendientes en la América hispana se ha vuelto común el pensar a los esclavos como sujetos del derecho derivado de las prácticas grecorromanas en todos aquellos tribunales a los que se sometieron por diversas causas. Empero, poco se ha estudiado de forma sistemática las prácticas jurídicas cotidianas usadas para enjuiciarlos. En este breve artículo se plantean algunas de éstas últimas, de las cuales el iuscomunne se considera como la forma preponderante de aplicar las leyes para ellos.
