Upaya Komisi Pemilihan Umum Dalam Pemenuhan Hak Konstitusional Penyandang Disabilitas Pada Pemilihan Umum Di Kota Gorontalo

The right to vote is one of the constitutional rights guaranteed by Article 28D of the 1945 Republic of Indonesia Law and enhanced by Article 43 paragraph (1) of Law Number 39 of 1999 concerning Human Rights. In the 2019 General Election there were 437 data on disabled voters, consisting of 239 men and 198 women. Then there were 349 people who exercised their right to vote with disabilities, consisting of 168 men and 181 women. However, there are still 88 voters with disabilities who do not exercise their right to vote in the 2019 General Election. So that the constitutional rights of persons with disabilities are not fulfilled can be one of the factors in not fulfilling the overall vote acquisition in the implementation of general elections. So that the formulation of the problem in this research is how the efforts of the General Election Commission in fulfilling the constitutional rights of persons with disabilities in general elections in the City of Gorontalo. The research objective is to examine the efforts of the General Election Commission in fulfilling the constitutional rights of persons with disabilities in the City of Gorontalo. This research method is empirical research using an empirical juridical approach. The results of this study indicate that the General Election Commission ensures that voters with disabilities who meet the requirements are registered as voters and guarantee the availability of supporting facilities and infrastructure for voters with disabilities to grant their right to vote accompanied by political education by democracy volunteers.  Hak pilih merupakan salah satu hak konstitusional yang dijamin oleh Pasal 28D Undang Undang Negara Republik Indonesia Tahun 1945 dan disempurnakan dengan pasal 43 ayat (1) Undang Undang Nomor 39 Tahun 1999 tentang Hak Asasi Manusia. Dalam Pemilihan Umum 2019 terdapat 437 data pemilih disabilitas, terdiri dari 239 laki-laki dan 198 perempuan. Kemudian yang menggunakan hak pilih disabilitas sebanyak 349 orang, terdiri dari 168 laki-laki dan 181 perempuan. Namun masih terdapat 88 pemilih disabilitas yang tidak menggunakan hak pilih pada Pemilhan Umum tahun 2019. Sehingga tidak terpenuhinya hak konstitusional penyandang disabilitas dapat menjadi salah satu faktor tidak terpenuhinya perolehan suara secara menyeluruh dalam pelaksanaan pemilihan umum. Sehingga rumusan masalah dalam penelitian ini adalah bagaimana upaya Komisi Pemilihan Umum dalam pemenuhan hak konstitusional penyandang disabilitas dalam pemilihan umum di Kota Gorontalo. Adapun tujuan penelitian yakni mengkaji upaya Komisi Pemilihan Umum dalam pemenuhan hak konstitusional penyandang disabilitas di Kota Gorontalo. Metode penelitian ini adalah penelitian empiris dengan menggunakan pendekatan yuridis empiris. Hasil penelitian ini menunjukkan bahwa Komisi Pemilihan Umum memastikan pemilih disabilitas yang memenuhi syarat terdaftar sebagai pemilih dan menjamin ketersediaan sarana dan prasarana pendukung bagi pemilih disabilitas guna memberikan hak pilih disertai dengan pendidikan politik oleh relawan demokrasi. &nbsp
