Le corps et le droit du travail : au cœur d’un paradoxe

So, in the subordination which characterizes the relation between employer and employee, the latter is often physically forced and gives its body to the employer. Limits at the free possession of the body at work are multiple. Nevertheless, the protection of this body at work was at the origin of the creation of the labor law and the numerous European and international standards. The stake is to guarantee a protection of the rights and the liberties of the person in its entirety without widening infinitely the spatiotemporal limits of the subordination of the worker.Les spécificités de la relation de travail portent en elles un paradoxe relatif au traitement et au statut juridiques du corps au travail : le corps du travailleur est à la fois l’objet de la prestation de travail et l’objet de la protection du droit. Ainsi, dans la subordination qui caractérise la relation entre employeur et salarié, ce dernier est souvent physiquement contraint et met son corps à la disposition de son employeur. Les limites à la libre disposition du corps au travail sont multiples. Pourtant, la protection de ce corps au travail fut à l’origine de la création même du droit du travail et de nombreuses normes européennes et internationales. L’enjeu est d’assurer une protection des droits et libertés de la personne dans sa globalité sans pour autant étendre indéfiniment les limites spatio-temporelles de la subordination du travailleur
