A CORTE INTERAMERICANA DE DIREITOS HUMANOS E AS CONDENAÇÕES APLICADAS AO ESTADO BRASILEIRO

The present study aims to analyze the competence of the Inter-American Court of Human Rights (CIDH) in the denouncements and sentences handed down against Brazil. To this end, it explains how the Inter-American System of Human Rights (IAHRS) was developed and how Brazil positioned itself in this process; analyzes the rights provided for in the American Convention on Human Rights (ACHR); and exposes some cases taken to the IACHR, the decisions handed down by the judges as well as the impacts of the Court's sentences for the prevention of future violations of human rights in Brazil. The theme was explored through bibliographical research carried out through doctrines, legal articles and documentary research, allowing to conclude that an important consequence for Brazilian Law arising from the Brazilian cases judged in the IACHR was the awareness of this international path of access to justice for reparation of violation of fundamental rights, previously restricted to the national internal legal order, since the national projection taken by these cases, produced a significant amount of books, articles and debates around the transnational justice exercised from the International Systems of Protection of Rights Humans, and more closely, the Inter-American. However, the struggle for the realization of human rights passes through the field of daily militancy, and normative instruments are not enough, nor the mere existence of institutions.O presente estudo objetiva analisar a competência da Corte Interamericana de Direitos Humanos (CIDH) nas denúncias e sentenças proferidas contrárias ao Brasil. Para tanto, explica como se desenvolveu o Sistema Interamericano de Direitos Humanos (SIDH) e como se posicionou o Brasil neste processo; analisa os direitos previstos na Convenção Americana de Direitos Humanos (CADH); e expõe alguns casos levados a CIDH, as decisões proferidas pelos juízes bem como os impactos das sentenças da Corte para prevenção de futuras violações de direitos humanos no Brasil. O tema foi explorado através de pesquisa bibliográfica realizada por meio de doutrinas, artigos jurídicos e pesquisa documental, permitindo concluir que uma consequência importante para o Direito brasileiro advinda dos casos brasileiros julgados na CIDH foi a conscientização deste caminho internacional de acesso à justiça para a reparação de violação de direitos fundamentais, antes restrita à ordem jurídica interna nacional, uma vez que a projeção nacional tomada por estes casos, produziu uma significativa quantidade de livros, artigos e debates em torno da justiça transnacional exercida a partir dos Sistemas Internacionais de Proteção de Direitos Humanos, e mais de perto, do Interamericano. No entanto, a luta pela concretização dos direitos humanos passa pelo campo da militância cotidiana, não sendo suficientes instrumentos normativos, nem a mera existência de instituições
