LA TUTELA DELLE INDICAZIONI GEOGRAFICHE PER I PRODOTTI NON COMPARABILI: IL RUOLO DEI GRUPPI DI PRODUTTORI NELLA VALORIZZAZIONE DEL SEGNO

ABSTRACT The geographical names registered as Protected Designations of Origin (PDOs) and Protected Geographical Indications (PGIs) receive, under regulations on quality schemes for agricultural products and foodstuff and grapevine products (Regulations EU Nos 1151/2012 and 1308/2013), an almost absolute protection. It consists of a prohibition on the use and the evocation of the certified name provided not only for the so-called “similar products”, but also for products non-comparable to those benefitting from PDO or PGI, provided that the conduct of the third party reflects an exploitation of the reputation of the protected name. The aim of this research is to investigate this second issue by drawing a distinction between a notion of non-comparability tout court, understood as a diversity among the products concerned in terms of the class of goods to which they belong, and a different notion that may considered strictly internal to the agricultural, foodstuff and wine sector. As for the first matter, the protection requirements are examined also in the light of the Court of Justice of the EU’s case law; in particular, the meanings of «reputation», «exploitation» e «non-comparability» are explained. As for the second one, the problem concerns the use of a PDO or PGI in the trade name of a foodstuff that does not benefit from the PDO/PGI but incorporate products benefitting from the registered name; this latter case received important conceptual clarification from the European Commission and the Court of Justice. Finally, the role played by the producer groups in safeguarding and promoting the quality mark is considered. As for the first function, the Italian solution of the authorization issued by the consortia for the protection of PDOs and PGIs to those who want to commercialize food containing a protected ingredient is analyzed, emphasizing the pros and cons of such legal instrument; in relation to the second function, the new perspectives of merchandising and initiatives aimed more generally at the promotion of the designation’s territory are explored. The comparison between the Italian and French experience is transversal to the topics covered in this paper: both legal systems share a strong interest in these issues, following the importance that food and wine play in the respective economies and cultural traditions. The idea that emerges from the evolution of positive law and case law is that European Union seems willing to shift the focus of the protection from the essential link between the objective characteristics of the product and its territory to the subjective and intangible profiles of the place name. ABSTRACT I nomi geografici registrati come Denominazioni di Origine Protetta (DOP) o Indicazioni Geografiche Protette (IGP) ricevono, ai sensi dei regolamenti in materia di regimi di qualità agroalimentare e vitivinicola (reg. UE n. 1151/2012 e reg. UE n. 1308/2013), una tutela «quasi assoluta». Essa, infatti, si sostanzia in un divieto d’uso e di evocazione del nome certificato non solo a fronte di prodotti simili all’alimento che beneficia della DOP o IGP, ma anche di prodotti non comparabili, a condizione che la condotta del terzo consista in uno sfruttamento della notorietà del toponimo. La ricerca si è proposta di indagare questo secondo profilo della tutela, compiendo una distinzione tra una “non comparabilità” tout court, per tale intendendosi una diversità tra i prodotti coinvolti dal punto di vista della loro categoria merceologica di appartenenza, e una più prettamente interna al settore agroalimentare o vitivinicolo. Quanto alla prima, vengono esaminati i presupposti della protezione anche alla luce degli orientamenti espressi dalla Corte di giustizia europea; ci si domanda, in particolare, quale sia il significato da attribuire alle espressioni «notorietà», «sfruttamento» e «non comparabilità». Con riguardo alla seconda, ci si interroga sull’utilizzo di una DOP o IGP nella denominazione di vendita di un alimento che non beneficia della suddetta DOP o IGP ma che contiene un ingrediente beneficiante; sul tema la Commissione europea prima, e la Corte di giustizia dopo, hanno fornito importanti indicazioni. Infine, è necessario comprendere il ruolo rivestito dai gruppi di produttori nella difesa e nella valorizzazione e promozione del segno. Quanto al primo profilo, si porta ad esempio il modello italiano dell’autorizzazione rilasciata dai consorzi di tutela a coloro che intendano commercializzare un alimento contenente l’ingrediente protetto, mettendo in luce i vantaggi e le criticità di un simile strumento; quanto alla seconda funzione, sono esplorate le nuove prospettive del merchandising e delle iniziative volte più in generale a promuovere il territorio della denominazione. La comparazione tra l’esperienza italiana e quella francese è trasversale a tutti i temi toccati: i due Paesi, infatti, condividono una particolare sensibilità a tali questioni, dovuta alla secolare tradizione enogastronomica che li accomuna. L’idea che emerge dall’analisi del dato positivo e giurisprudenziale è che l’Unione Europea sposta sempre più il focus della salvaguardia dal legame, essenziale, tra le caratteristiche oggettive del prodotto e il territorio ai profili soggettivi e immateriali del toponimo
