Fundamentals of Innovative Understanding of the Essence, Functions, System and the Procedure for the Formation of Anti-Offenses Bodies: Third Part

It has been substantiated that the “IQ” testing used in the competitions of antidelictologists actually means not the coefficient of intelligence, but the level of solving special problems, which is not associated with the ability to most effectively, rationally and efficiently carry out a certain type of antidelict activity. A variant of radical reform of the advocacy, tracetura, experttura, ordistatura; and of the executetura and the appearance of a the publictura is presented. It was emphasized that the existing function of the prosecutor's office in the procedural direction of the investigation should be transferred to the heads of the investigative divisions of the tracetura, united on the basis of the principle of one-man command over the entire spectrum of jurisdiction. The function of accusation and other protection of the legal status of the victim should be transferred to a newly created anti-delict body - a publictura, which should also act on the principle of one-man management, receive employee salaries and other material and technical support only from the state and have two divisions: a) accusations and other protection the legal status of the victim in all types of juridical proceedings; b) other juridical assistance.
