L'animal et le droit : à propos de la Déclaration universelle des droits de l'animal

The Universal Declaration of Animal Rights is often portrayed as an international law instrument that should be seen as the counterpart of the Universal Declaration of Human Rights. A doser scrutiny shows that it is nothing of the sort : it is in fact an instrument adopted by a non-governmental organization. However, this confusion reveals much about the legal status of the animal. An examination of the Declaration's content shows that instead of a single declaration, there are actually two declarations. The differences between the 1977 text and that of 1989 are very significant with regard to the animal and its relationship with man. The earlier text, which might be categorised as pathocentric, is based on the need to protect the animal because it can feel pain and suffering. The second, on the other hand, would seem to be closely linked to deep ecology which affirms that no distinction should be drawn between living creatures.La Déclaration universelle des droits de l'animal est souvent présentée comme un acte de droit international qui serait le pendant de la Déclaration universelle des droits de l'homme. A l'examen, il n'en est rien ; c'est un acte adopté par une organisation non-gouvernementale. La confusion est néanmoins significative du statut juridique de l'animal. L'examen de son contenu montre que plutôt que d'une déclaration, c'est de deux déclarations qu'il faut parler. Les différences entre le texte de 1 977 et celui de 1989 sont significatives des conceptions de l'animal et de ses rapports avec l'homme. La première, que l'on peut qualifier de pathocentrique, repose sur la nécessité de protéger l'animal en raison de la souffrance qu'il peut ressentir. La seconde, par contre, semble pouvoir être rattachée à l'écologie radicale - deep ecology- qui postule l'indifférenciation entre êtres vivants.Babadji Ramdane.
