Análise jurídica sobre a plena legalização do aborto no primeiro trimestre de gestação

The present work is a monograph, a requirement for obtaining a Bachelor of Law degree at the Federal University of Sergipe. The issue addressed covers the area of Criminal Law and is the result of a great debate in the academic community, due to new legislative updates on the subject worldwide. The problem is aimed at analyzing the feasibility of full legalization of abortion in the first trimester of pregnancy and its legal effects. For this, the hypothetical deductive approach method was used , with extensive bibliographic and documentary research. In this sense, first, the study begins with a brief legal and historical contextualization on the subject, with the aim of understanding its homeland roots, as well as understanding the impact of ext ravagant legislation. Subsequently, the theme of boarding in contemporary Brazilian law is presented, both from a constitutional point of view, as well as a penal one. After that, the legal view of the embryo in the first trimester of pregnancy is analyzed , as well as the dangers of clandestine abortion. Finally, a thorough study is carried out on the bills on the subject in Brazil, as well as the importance that HC 124.306 RJ had for further elucidation of the subject.O presente trabalho se trata de uma monografia, requisito para a obtenção do grau de Bacharel em Direito na Universidade Federal de Sergipe. A questão abordada abrange a área do Direito Penal e é fruto de grande debate na comunidade acadêmica, em virtude das novas atualizações legislativas sobre o tema em todo o mundo. A problemática está voltada a analise da viabilização da plena legalização do aborto no primeiro trimestre de gestação e seus efeitos jurídicos. Para isso, foi utilizado o método de abordagem hipotético dedutivo, com vasta pesquisa bibliográfica e documental. Nesse sentido, p or primeiro, o estudo se inicia com a breve contextualização jurídica e histórica sobre o tema, com o intuito de compreender as suas raízes pátrias, bem como entender o impacto da legislação extravagante. Posteriormente, é apresentada a temática do abordo no direito brasileiro contemporâneo, tanto sob uma ótica constitucional, como também penalista. Após isso, é analisada a visão jurídica do embrião no primeiro trimestre de gestação, bem como os perigos do aborto clandestino. Por fim, é realizado um profundo estudo sobre os projetos de lei a respeito do tema no Brasil, bem como a importância que o HC 124.306 RJ teve para uma maior elucidação do assunto.São Cristóvão, S
