PENYELESAIAN SENGKETA PEMBAGIAN WARIS KEPADA GOLONGAN DZAWIL ARHAM MELALUI LITIGASI DAN NON LITIGASI DALAM PERSPEKTIF SISTEM PEWARISAN ISLAM

ABSTRACT Dzawil arham is a kinship group of heirs who are not heirs, but under certain circumstances are entitled to inheritance as a substitute for the position of heirs (substitute heirs). The replacement of the position of the substitute heir is an adaptation of the western inheritance system, known as plaatsvervulling. Based on Islamic jurisprudence based on the Al-Quran and Al-Hadith, the distribution of inheritance to the dzawil arham group must be reasonable or appropriate, even though the Compilation of Islamic Law does not explain in detail the amount of the distribution. In practice, there are many disputes over the distribution of inherited assets that are not in accordance with their portions, and some even control the assets unilaterally without regard to the rights of other heirs. Therefore this article aims to provide insight to the public that the settlement of Islamic inheritance can be resolved through litigation (through court) or through non-litigation or amicably. The research method is carried out in a normative juridical manner with secondary data as the main data supported by primary data. It was concluded that because inheritance problems are problems involving family and kinship, so if a dispute occurs, it is better to settle it by deliberation to reach a consensus between the parties (non-litigation).
