Le foncier agricole en Provence Alpes Côte d'Azur : spécificité, défense et restructuration

Beyond the regional diversity, this study shows the specific aspects of the agricultural landownership problem in the region of Provence Alpes Côte d'Azur overwhelmed with a multiform and galloping urbanization. The land acquisitions by the non-agricultural people which represents in France 23 % of the sold surfaces reaches there 65 %. From this situation arise severe perturbations on the market of agricultural lands and the multiplication of fallow lands which is a grave threat to the steadiness of agriculture. To preserve 'this landownership, original actions have been worked out such as the charters of agricultural areas in the Bouches du Rhône and Var département. But the battle of landownership is far from being won. As far as land restructuration of holdings within the agricultural areas is concerned, the various measures conceived on the national scale have had nothing but limited effects. The regroupings of lands are almost non-existent apart from the mountainous area, the legislation about waste lands, ineffective. The «Indemnité Viagère de Départ » has enabled for ten years to accelerate the liberation of landownership which is to be appreciated in a narrow market area. The intervention of S.A.F.E.R. which does not include the département of Alpes Maritimes, situates itself at a level widely inferior to that of the french average in spite of the activity it displays and the realizations of particularly successful operations. Owing to the specific actions they are planning, the O.G.A.F., allow their measures to be more suitable to the social context but as they are very few, their impacts are too localized.Au delà de la diversité régionale, cette étude montre les aspects spécifiques du problème foncier agricole dans la région Provence Alpes Côte d'Azur submergée par une urbanisation galopante et multiforme. Le poids des acquisitions foncières des non-agriculteurs qui représente en France 23 % des surfaces vendues, atteint ici 67 %. Il s'ensuit de graves perturbations sur le marché des terres agricoles : prix élevés sans rapport avec le revenu agricole et multiplication des friches qui menacent le maintien de l'agriculture . Des actions originales de protection du foncier agricole ont été élaborées, comme les chartes dès zones agricoles des Bouches du Rhône et du Var, mais la bataille du foncier est loin d'être gagnée. En ce qui concerne la restructuration foncière des exploitations au sein des zones agricoles, les diverses mesures conçues au niveau national n'ont eu que des effets très limités. Les remembrements sont quasiment inexistants en dehors de la zone de montagne, la législation sur les terres incultes inopérante. Toutefois, l'I.V.D., pendant une dizaine d'années, a permis d'accélérer la libération du foncier, ce qui est appréciable dans une zone à marché très fermé. L 'intervention de la S.A.F.E.R. qui ne comprend pas le département des Alpes Maritimes, se situe à un niveau largement inférieur à celui de la moyenne française, malgré l'activité qu'elle déploie et la réalisation d'opérations particulièrement bien réussies. Les O.G.A.F., grâce aux actions spécifiques qu'elles prévoient permettent de mieux adapter les mesures au contexte local; mais, peu nombreuses, elles n 'ont que des impacts trop localisés.Durbiano Claudine, de Reparaz André.
