Los privados de libertad y el sistema de rehabilitación social en Ecuador

The present investigation refers to the analysis of the punitive power of the state to sanction behaviors of both actions and omissions that affect a protected legal good and also the fulfillment of the penalties imposed by a jurisdictional authority.  Furthermore, it implies a system of rehabilitation and social reintegration that presents barriers and shortcomings, without ruling out the normative recognition of a wide catalog of rights. In addition, it involves the principles and guidelines for the treatment of prisoners who, in the context of the constitutional state model of rights and justice, have been categorized as a priority attention group. Therefore, the objective is to analyze the Ecuadorian prison system and the problems afflicting, to determine the appropriate state action in order to ensure the comprehensive rehabilitation and socioeconomic reintegration of the prison population. For such purpose, a documentary research and review of bibliographic type has been carried out, applying the inductive- deductive methods besides the historical -logical.El presente trabajo investigativo, hace alusión al análisis del poder punitivo del estado  para sancionar conductas, tanto acciones como omisiones que afecten un bien jurídico protegido, y el cumplimiento de las penas impuestas por una autoridad jurisdiccional, dentro de un sistema de rehabilitación y reinserción social que presenta barreras y falencias, sin descartar el reconocimiento normativo de un catálogo amplio de derechos, principios y guías para el tratamiento de los privados de libertad a quienes, en el contexto del modelo de Estado constitucional de derechos y justicia, se los ha categorizado como un grupo de atención prioritaria. Por lo que el objetivo es analizar el sistema penitenciario ecuatoriano y las problemáticas que lo aquejan, para determinar la adecuada actuación estatal en cautela de la rehabilitación integral y la reinserción socioeconómica de la población carcelaria. Para lo cual se ha realizado una investigación documental y de revisión de tipo bibliográfica, aplicando los métodos inductivos –deductivos a más del histórico –lógico
