Libre movilidad humana y políticas públicas de protección a extranjeros desde el derecho constitucional ecuatoriano

This scientific article seeks to determine the degree to which the law guarantees the rights of the person in condition of mobility, called immigrant, within the Ecuadorian State. The research is of documentary descriptive type, documentary analysis was carried out, information was explored and analyzed in previous researches, texts among others. It is considered as a current problem that deserves an effective analysis, allowing to evidence the shortcomings of the law and the regression of the rights necessary for a true social justice. Human mobility is considered a right and for it to be guaranteed it is necessary to have legal mechanisms that allow it, promoting the free exercise of equality as a fundamental right. Thus, an analysis of the realities of people in a state of mobility was carried out, in which social problems are evidenced. It is recommended that regulations be strengthened to safeguard the rights of this group of people.El presente artículo científico busca determinar el grado en el que la ley garantiza los derechos de la persona en condición de movilidad, denominado inmigrante dentro del Estado ecuatoriano. La investigación es de tipo descriptiva documental, se realizó análisis documental, se exploró y analizó información en investigaciones previas, textos entre otros. Considerándose como una problemática de actualidad y que amerita un análisis eficaz, permitiendo evidenciar las falencias de la ley y la regresión de los derechos planteados necesarios para una verdadera justicia social. La movilidad humana es considerada un derecho y para que este sea garantizado es necesario contar con mecanismos legales que lo permitan, promoviendo el libre ejercicio de la igualdad como derecho fundamental. Se realizó así, un análisis de las realidades de las personas en estado de movilidad, en la que se evidencia problemáticas sociales. Se recomienda el fortalecimiento de la normativa para salvaguardar los derechos de este grupo de personas
