Ιus gentium y soberanía: el caso de Francisco de Vi(c)toria

The issues of this research are primarily related to the concept of natural law as opposed to issues of sovereignty during the period of the Spanish Colony of the New World. The research project approaches the Spanish colonial environment of the New World through a more general readjustment of philosophical, theological, and political thought on the field of the philosophy of law during the period of Εarly Modern Europe.Basic objective of this research is the presentation of the philosophical thought of Francisco de Vitoria, one of the most important lecturers and founders of international law in Spain during the 16th century. A secondary goal is to fill a large and distinct gap in the Greek-language scientific bibliography in the Spanish philosophical space of thought.Through this research, a complex range of conflicting doctrines and stereotypes of the examined thinker emerged in fields such as nature, law, politics, human rights, the concept of sovereignty, the role of the church, and the role of the sovereign state.The main conclusion is the existence of legal status and a philosophical framework based on which the concept of law is regulated in every field of human existence. The re-approach of contemporary issues such as the humanitarian crisis, immigration, and the geopolitical revisionism of states through the scope of this research tends to create a very interesting field of philosophical reflection in the field of law.Τα ζητήματα αυτής της έρευνας σχετίζονται πρωτίστως με την έννοια του φυσικού δικαίου σε σχέση με θέματα κυριαρχίας κατά την περίοδο της Ισπανικής ανακάλυψης του Νέου Κόσμου. Το όλο ερευνητικό εγχείρημα προσεγγίζει το αποικιοκρατικό περιβάλλον της Ισπανικής κατάκτησης του Νέου Κόσμου μέσα από μία γενικότερη αναπροσαρμογή της φιλοσοφικής, θεολογικής και πολιτικής σκέψης πάνω στο πεδίο της φιλοσοφίας του δικαίου κατά την περίοδο της πρώιμης Νεότερης Ευρώπης.Κύριος στόχος της συγκεκριμένης έρευνας είναι η παρουσίαση της φιλοσοφικής σκέψης του Francisco de Vitoria, ενός εκ των σημαντικότερων εισηγητών και θεμελιωτών του διεθνούς δικαίου στην Ισπανία κατά τον 16ο αιώνα. Δευτερεύων στόχος είναι η πλήρωση ενός μεγάλου και διακριτού κενού στην ελληνόγλωσση επιστημονική βιβλιογραφία στον Ισπανικό φιλοσοφικό χώρο σκέψης.Με την έρευνα αυτή αναδεικνύεται ένα φάσμα συγκρούσεων δογμάτων και στερεοτύπων του εξεταζόμενου στοχαστή σε πεδία όπως η φύση, το δίκαιο, η πολιτική, τα ανθρώπινα δικαιώματα, η έννοια της κυριαρχίας, ο ρόλος της εκκλησίας, ο ρόλος του κυρίαρχου κράτους.Κύριο συμπέρασμα αποτελεί η ύπαρξη ενός νομικού status και ενός φιλοσοφικού πλαισίου τα οποία ρυθμίζουν τη λειτουργία του δικαίου σε κάθε πεδίο της ανθρώπινης ύπαρξης. Αυτό είναι σημαντικότατο, κυρίως στην εποχή μας που αντιμετωπίζει πολύπλοκα προβλήματα όπως η ανθρωπιστική κρίση, το μεταναστευτικό και ο γεωπολιτικός αναθεωρητισμός μεταξύ άλλων.Los temas de esta investigación se relacionan principalmente con el concepto de la ley natural en relación con cuestiones de soberanía la época de la colonización española del Nuevo Mundo. El proyecto de la investigación estudia el ambiente colonial del Nuevo Mundo a través de un reajuste más general del pensamiento filosófico, teológico y político que se centra en el campo de la filosofía del derecho durante el período de la temprana Europa moderna. Οbjetivo principal de esta investigación es destacar el pensamiento filosófico de Francisco de Vitoria -uno de los más importantes fundadores del derecho internacional en España el siglo XVI- introduciéndolo en en mundo griego actual. A través de esta investigación, surge un conjunto de doctrinas conflictivas y estereotipos del pensador examinado en campos como la naturaleza, el derecho, la política, los derechos humanos, el concepto de soberanía, el papel de la iglesia, el papel del estado soberano. La conclusión principal de la investigación es la existencia un estatuto jurídico y un marco filosófico que imponen la función del derecho en todos los niveles de la existencia humana. Ello es de suma importancia, especialmente para nuestra época que enfrenta problemas como la crisis humaninaria, las migraciones y el revisionismo geopolítico entre otros
