This article aims to explain and reach a common denominator to understand whether or not the coronavirus should be recognized as an occupational disease, as well as its social and legal impacts that such an application would entail in the employment relationship between employer and employer, as well as understand how employers are held accountable in such factual situations. The method used for the research was deductive, based on legislation, published articles and doctrines to reach a logical and rational conclusion for the framing of COVID-19 as an occupational disease.
