Judicial Review of Unacceptability of Lawsuits Against Land Disputes (Decision Study No.372 / Pdt.G / 2014 / PN.Mdn)

Mekanisme penyelesaian sengketa yang dimaksud berupa sistem peradilan. Peradilan yang dimaksud adalah pelaksanaan hukum dalam hal konkrit adanya tuntutan hak, fungsi mana dijalankan oleh suatu badan yang berdiri sendiri dan diadakan oleh negara serta bebas dari pengaruh apa dan siapapun dengan cara memberikan putusan yang bersifat mengikat. Permasalahan dalam penelitian ini adalah apakah faktor-faktor penyebab gugatan tidak dapat diterima pada perkara sengketa tanah pada Putusan No. 372/Pdt.G/2014/PN.Mdn dan bagaimana dasar pertimbangan hakim tidak menerima gugatan penggugat pada Putusan No. 372/Pdt.G/2014/PN.Mdn. Metode penelitian yang digunakan adalah penelitian normatif yaitu jenis penelitian yang dilakukan dengan mempelajari norma-norma yang ada atau peraturan perundang-undangan yang terkait dengan permasalahan yang dibahas. Sifat penelitian yang dipergunakan dalam menyelesaikan skripsi ini adalah deskriptif analisis. Menggunakan metode penelitian kepustakaan (Library Research) yaitu dengan melakukan penelitian terhadap berbagai sumber bacaan yaitu peraturan undang-undang, buku-buku, majalah hukum, pendapat para sarjana, dan juga bahan-bahan kuliah. Penelitian lapangan (Field Research) yaitu dengan melakukan kelapangan dalam hal ini penulis langsung melakukan studi pada Pengadilan Negeri Medan dengan mengambil Putusan No. 372/Pdt.G/2014/PN.Mdn, untuk dianalisis. Analisis data yang digunakan adalah data kualitatif. Faktor-faktor penyebab gugatan perdata di tolak pada Pengadilan Negeri yaitu dalil gugatan atau fundamentum petendi, tidak mempunyai dasar hukum yang jelas. Suatu gugatan dianggap kabur apabila dalil gugatan tidak menjelaskan dasar hukum dan peristiwa yang melatarbelakangi gugatan. Objek sengketa yang tidak jelas, Tidak disebutnya letak tanah Tidak samanya batas, Petitum gugatan tidak jelas, Gugatan masih premature dan Gugatan telah daluwarsa. Pada Putusan No. 372/Pdt.G/2014/PN.Mdn Penggugat merasa dirugikan oleh pihak Tergugat, namun dalam hal ini dalil-dalil isi gugatan penggugat tidak beralasan dan berdasar. Dasar pertimbangan hakim dalam memutuskan perkara perdata No. 372/Pdt.G/2014/PN.Mdn objek gugatan yang masih diperiksa dalam perkara lain (Litispendentie exceptie), yang merupakan objek dalam sengketa perdata dalam perkara ini yang merupakan alasan penggugat mengajukan gugatan.The dispute resolution mechanism referred to is in the form of a justice system. The court in question is the implementation of the law in terms of concrete demands for rights, which functions are carried out by an independent body and held by the state and are free from any influence whatsoever and by giving binding decisions. The problem in this study is whether the factors causing the lawsuit cannot be accepted in the land dispute case in Decision No. 372 / Pdt.G / 2014 / PN.Mdn and how the basic consideration of the judge did not accept the plaintiff's claim in Decision No. 372 / Pdt.G / 2014 / PN.Mdn. The research method used is normative research that is the type of research conducted by studying existing norms or legislation related to the issues discussed. The nature of the research used in completing this thesis is descriptive analysis. Using the method of library research (Library Research) that is by conducting research on various sources of reading, namely the rule of law, books, law magazines, opinions of scholars, and also lecture materials. Field research (Field Research) that is by doing spaciousness in this case the author directly conducts a study at the Medan District Court by taking Decision No. 372 / Pdt.G / 2014 / PN.Mdn, for analysis. Analysis of the data used is qualitative data. The factors that cause civil lawsuits to be rejected at the District Court are the arguments of the claim or fundamentals of the petitioner, do not have a clear legal basis. A lawsuit is considered vague if the argument of the lawsuit does not explain the legal basis and the event behind the suit. The object of the dispute is unclear, the location of the land is not mentioned. There are no equal borders, the lawsuit is unclear, the lawsuit is premature and the lawsuit has expired.
