73 HalamanPerlindungan hukum merupakan salah satu cara terbaik untuk memproteksi suatu subjek hukum dari kesewenangan yang diterapkan. Perlindungan hukum mencangkup secara luas dalam segi tatanan hukumnya. Perlindungan hukum salah satunya diberikan kepada suatu kegiatan usaha. Perlindungan hukum penting untuk diberikan demi menjamin proteksi terhadap suatu usaha agar tetap berjalan dengan baik. Dalam pemberian fasilitas kredit yang tertuang dalam suatu perjanjian kredit oleh bank kepada debitur bukanlah tanpa resiko, karena resiko mungkin saja terjadi khususnya karena debitur tidak wajib membayar utangnya secara lunas atau tunai, maka dengan adanya hak tanggungan akan memberi kemudahan dan kepastian hukum pelaksanaan eksekusi apabila debitur cidera janji. Berdasarkan uraian singkat di atas dalam penelitian ini peneliti menemukan masalah mengenai proses kredit dengan Jaminan Hak Tanggungan, bentuk perlindungan Hukum yang diberikan kepada Kreditur dalam Perjanjian Kredit dengan Jaminan Hak Tanggungan ketika Debitur Wanprestasi. Tujuan penelitian ialah untuk mengetahui proses kredit dengan jaminan hak tanggungan, untuk mengetahui bentuk perlindungan hukum yang diberikan kepada kreditur dalam perjanjian kredit dengan jaminan hak tanggungan ketika debitur wanprestasi. Metode penelitian yang digunakan adalah penelitian yuridis normatif, sistem pengumpulan data yaitu dengan Library riset (penelitian kepustakaan dan wawancara dengan Hakim maupun dengan Panitera di Pengadilan Negeri Medan sebagai tempat perkara di putuskan. Proses kredit dengan jaminan hak tanggungan yaitu pengajuan aplikasi kredit, penelitian berkas kredit, penilaian kekayaan di dalamnya tercantum jumlah atau besar kredit yang disetujui, jangka waktu pengembalian kredit, biaya-biaya seperti besarnya bunga dan biaya lain yang diperlukan, syarat-syarat penarikan kredit, cara pengembalian kredit, bentuk jaminan kredit dan nilainya, perlindungan hukum yang diberikan kepada kreditur dalam perjanjian kredit dengan jaminan hak tanggungan ketika debitur wanprestasi adalah mengacu pada Undang-Undang Nomor 4 Tahun 1996 Tentang Hak Tanggungan, grosse akta pengakuan hutang. Legal protection is one of the best ways to protect a legal subject from arbitrariness being applied. Legal protection covers broadly in terms of legal structure. One of the legal protections is given to a business activity. Legal protection is important to provide in order to ensure protection of a business so that it continues to run well. The provision of credit facilities contained in a credit agreement by the bank to the debtor is not without risk, because the risk may occur, especially because the debtor is not obliged to pay his debt in full or in cash, then the existence of a mortgage will provide convenience and legal certainty for the implementation of execution if the debtor is breach of contract. Based on the brief description above, in this study the researcher found problems regarding the credit process with the Mortgage Guarantee, a form of legal protection provided to Creditors in the Credit Agreement with Mortgage Guarantee when the Debtor is in Default. The research objective is to determine the credit process with guarantee of mortgage rights, to determine the legal protection provided to creditors in a credit agreement with guarantees of mortgage rights when the debtor defaults. The research method used is normative juridical research, the data collection system is a research library (library research and interviews with judges and clerks at the Medan District Court as the place where the case is decided. Credit process with guarantees of mortgage rights, namely submitting credit applications, researching credit files , the assessment of wealth includes the amount or amount of credit approved, the period for returning the credit, fees such as the amount of interest and other fees required, terms of credit withdrawal, method of credit repayment, form of credit guarantee and value, legal protection provided to Creditors in credit agreements with guarantees of mortgages when the debtor is in default is referring to law number 4 of 1996 concerning mortgages, grosse deed of debt recognition
