65 HalamanPada awalnya, pelaku di kecelakaan lalu lintas tidak sengaja dilakukan hingga pada akhirnya mereka menyebabkan kecelakaan karena kelalaian tersebut. Di dalam Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan, perilaku tersebut dapat dipidana dengan pidana penjara, namun dalam perkembangannya konsep restorative justice memilih jenis pidana penjara yang menjadi pilihan terakhir dan hal tersebut menjadi poin penting dalam merundingkan pendamaian antara kedua pihak yaitu pelaku dan keluarga korban. Pada umumnya, di kasus kecelakaan lalu lintas, keterlibatan polisi adalah bertindak sebagai penyidik untuk mendalami kasus ini. Permasalahan yang dibahas dalam skripsi ini adalah mengenai Bagaimana Penerapan Restorative Justice dalam penyelesaian kasus kecelakaan lalu lintas yang mengakibatkan kematian di Wilayah Kepolisian Polres Pelabuhan Belawan. Kendala Penerapan Restorative Justice dalam penyelesaian kasus kecelakaan lalu lintas yang mengakibatkan kematian di Wilayah Kepolisian Polres Pelabuhan Belawan. Jenis penelitian yang digunakan pada skripsi ini menggunakan hukum normatif, yaitu metode penelitian dokumen-dokumen berdasarkan berbagai bahan sekunder berupa peraturan perundang-undangan, putusan pengadilan, dan teori-teori yang berkaitan dengan hukum, serta dapat juga berupa pendapat para ahli/akademisi. Hasil dari penelitian ini adalah menerapkan restorative justice untuk penyelesaian kasus kecelakaan lalu lintas yang berujung pada kematian dengan menitikberatkan pada peran langsung pelaku tindak pidana, korban, dan saksi seperti masyarakat dalam proses penyelesaian kasus pidana. Konsep restorative justice didasarkan pada kritik terhadap penerapan sistem peradilan pidana, dan pemenjaraan dianggap tidak efektif dalam menyelesaikan konflik sosial. Kendala dalam penerapan dari konsep restorative justice dalam penyelesaian kasus kecelakaan lalu lintas yang berujung pada kematian adalah terbatasnya anggaran untuk memberikan pelayanan terbaik kepada masyarakat, dan menjadi kendala-kendala dan masalah yang krusial dalam memberikan pelayanan terhadap penanganan kasus kecelakaan lalu lintas. Hal ini menjadi kendala dalam penanganan kecelakaan di wilayah hukum Polres Pelabuhan Belawan. The problem discussed in this thesis is regarding the application of Restorative Justice in resolving cases of traffic accidents that resulted in death in the Belawan Harbor Police area. The type of research used in this thesis uses normative law, namely the method of researching documents based on various secondary materials in the form of legislation, court decisions, and theories related to law, and can also be in the form of opinions of experts/academics. The result of this research is to apply restorative justice for solving traffic accident cases that lead to death by focusing on the direct role of criminals, victims, and witnesses such as the community in the process of resolving criminal cases. The concept of restorative justice is based on criticism of the implementation of the criminal justice system, and imprisonment is considered ineffective in resolving social conflicts. Constraints in the application of the concept of restorative justice in solving traffic accident cases that lead to death are the limited budget to provide the best service to the community, and become crucial obstacles and problems in providing services for handling traffic accident cases.
