PENERAPAN RESTORATIVE JUSTICE TERHADAP PENYELESAIAN KASUS KECELAKAAN LALU LINTAS YANG MENGAKIBATKAN KORBAN MENINGGAL DUNIA (Studi Kasus di Polres Kabupaten Kediri)

Along with the development of the transportation sector, it is necessary to have Road Traffic and Transportation (LLAJ) regulations to increase social mobility in society and avoid traffic accidents that cause victims died. One of the resolutions of accident cases is restorative justice. The purpose of this research is the first, to find out how the application of Restorative Justice to cases of traffic accidents that cause victims to die in Kediri Regency. Second, to find out the obstacles faced by the District Police Kediri. The research method used is sociological juridical, interview data collection method and literature study, qualitative descriptive data analysis. The results of the study first, the application for a restorative court in connection with a traffic accident in which a person was killed in Kediri refers to the rules of Article 5 of the Indonesian National Police Law Number 8, Article 6 of the Indonesian National Police Law Number 8 of 2021, Article 310 paragraph 4 Indonesian National Police Law Number 22 of 2009, however in Kediri Regency still few demands for restorative justice in cases of accidents that resulted in the victims died. Because the victim's family does’nt agree that restorative decision should be carried out to abolish the punishment for the person who did it. Second, the obstacle to the application of restorative justice in the Kediri Regency area is because there is a conflict of interest between the perpetrator and the victim of a traffic accident, which in this aspect is wanting high compensation for a traffic accident especially the victim, still thinks negatively about the police and the court that justice Restorative action is carried out because the legal party in charge of obtaining bribes from the perpetrators so that the perpetrators are given a light sentence or even freed from punishment
