El procedimiento administrativo sancionador y la facultad normativa sancionadora de los gobiernos autónomos descentralizados cantonales

The objective is to analyze the sanctioning administrative procedure and the sanctioning normative power of the cantonal decentralized autonomous governments. A descriptive documentary research was conducted with a non-experimental bibliographic design and content analysis technique with the intention of analyzing the documents scrutinized. In order to guarantee the due process, the ordinances that violate the rights of the administered in terms of due process should be reformed, making effective the normative power that the law grants to the municipal council as the highest legislative body and, as the councilmen say, a normative control would be carried out. On the part of the Ecuadorian State, it must be clearly established what hierarchy the opinions of the Attorney General of the State have and if we are going to put them over the law that it is correctly established in the normative pyramid that is contemplated in the Constitution of the Republic of EcuadorSe tiene por objetivo analizar el procedimiento administrativo sancionador y la facultad normativa sancionadora de los gobiernos autónomos descentralizados cantonales. Se gestionó una investigación de tipo documental descriptiva con diseño bibliográfico no experimental con técnica de análisis de contenido con la intención de analizar los documentos escrutados. Para garantizar el debido proceso se debería reformar las ordenanzas que vulneren los derechos de los administrados en cuanto al debido proceso, haciendo efectiva la facultad normativa que la ley le concede al concejo municipal como máximo órgano legislativo y como los ediles manifiestan de fiscalización, en lo dicho se estaría realizando una fiscalización normativa. Por parte del Estado ecuatoriano, se debe establecer claramente que jerarquía tienen las opiniones del Procurador General del Estado y si las vamos a poner sobre la ley que se establezca correctamente en la pirámide normativa que se contempla en la Constitución de la República del Ecuador
