El modelo social de discapacidad: un cambio de paradigma y la reforma del artículo 49 CE

The first part of the article analyses how the idea of ​​disability has evolved over the course of human history. Further on, it is analysed how the current social model of disability has been applied at the international, European and national level. As will be seen, the United Nations Convention on the Rights of Persons with Disabilities is especially important in this context. One of the major novelties introduced by the Convention is the idea of universal accessibility. This idea, together with the legal concept of “reasonable accommodation”, is gaining great importance in the protection of the rights of persons with disabilities. The concept of “reasonable accommodation” has been applied by the European Court of Human Rights, the European Committee of Social Rights and the Spanish Constitutional Court. The last part of the article analyses the possibility of reforming article 49 of the Spanish Constitution. The purpose of the reform is to adapt the content of the precept to the current social model of disability and eliminate the unfortunate term “mentally handicapped”. This reform should be made in due form and with the widest possible consensus. However, the draft reform of article 49 presented by the Committee of Ministers on May 11, 2021, -now subject under parliamentary debate- contains significant content issues and technical inaccuracies. In addition, the lack of consensus threatens its adoption.En la primera parte del artículo se analiza cómo ha evolucionado la idea de discapacidad a lo largo de la historia. Más adelante, se analiza cómo se ha aplicado el actual modelo social de discapacidad a nivel internacional, europeo y nacional. La Convención de la Naciones Unidas sobre los Derechos de las Personas con Discapacidad es especialmente importante en este ámbito. Una de las mayores novedades que introduce la Convención es la idea de accesibilidad universal que, unida al concepto de “ajustes razonables”, está adquiriendo una gran importancia en la protección de las personas con discapacidad. El concepto de “ajustes razonables” ya ha sido aplicado por el Tribunal Europeo de Derechos Humanos, por el Comité Europeo de Derechos Sociales y por nuestro Tribunal Constitucional. En la última parte del artículo se analiza la posibilidad de reformar el artículo 49 de la Constitución para eliminar el desafortunado término “disminuidos” y adaptar su contenido al actual modelo social de discapacidad. La reforma del artículo 49 de la Constitución es oportuna y necesaria, pero debe hacerse de la forma debida y contando con el mayor consenso posible. Sin embargo, el Anteproyecto de reforma del artículo 49 presentado por el Consejo de Ministros, el 11 de mayo de 2021 -y que actualmente se encuentra bajo tramitación parlamentaria-, sufre importantes deficiencias técnicas y de contenido.
