Education and Human Rights: Approaches from a Critical Latin American Perspective.

El artículo tiene por objetivo analizar la visión de los derechos humanos y la educación en América Latina desde una perspectiva crítica. En los últimos años, la universalidad de los derechos humanos ha venido cuestionándose, al señalarse que las peculiaridades y circunstancias sui generis de la región, no responden a las definiciones abstractas del derecho promovidas por Occidente. Entendido de esta manera, la dupla conceptual educación/derechos humanos, se han presentado como instrumentos para reproducir patrones coloniales de exclusión y marginación social, dando lugar a los intereses del mercado global, así como al avance del capitalismo. Con estas premisas, no se pretende negar la dignidad intrínseca de todo ser humano; por el contrario, trata de visibilizar las estructuras de poder colonial que han tergiversado la condición humana. El trabajo finaliza invitando a una lectura crítica de la educación y los derechos humanos, entrando en contacto con una racionalidad antihegemónica y antisistémica, en consonancia con las necesidades de los pueblos, de sujetos reales y de comunidades excluidas por la lógica de la modernidad.This paper aims to analyze the vision of human rights and education in Latin America from a critical perspective. In recent years, the universality of human rights has been questioning, noting that the peculiarities and sui generis circumstances of the region do not respond to the abstract definitions of law promoted by the West. Understood in this way, the conceptual duo education / human rights have been presented as instruments to reproduce colonial patterns of exclusion and social marginalization, responding to the interests of the global market, as well as the advance of capitalism. With these premises, it is not intended to deny the intrinsic dignity of every human being; on the contrary, it tries to make visible the colonial power structures that have distorted the human condition. The work ends by inviting a critical reading of education and human rights, coming into contact with an anti-hegemonic and anti-systemic rationality, in line with the needs of peoples, real subjects and communities excluded by the logic of modernit
