Peranan Notaris Dalam Kepastian Hukum Akta Kuasa Menjual Terhadap Objek Jual Beli Yang Pailitkan

Tujuan penelitian ini untuk mengetahui peran Notaris dalam terkait kepastian hukum akta kuasa menjual terhadap objek yang di pailitkan dan untuk dapat mengetahui akibat hukum serta pertanggung jawaban hukum. Putusan pernyataan pailit debitur demi hukum kehilangan haknya untuk menguasai dan mengurus harta kekayaan yang ia miliki. Seluruh Aset debitur, baik yang ada maupun yang akan ada dikenakan sita umum. Metode penulisan ini bersifat kualitatif analitif dan menggunakan metode penelitian yuridis normatif yang berorientasi pada data yang bersumber dar literatur maupun studi kepustakaan. Metode penelitian tersebut menghasilkan kesimpulan kepailitan akan berakhir apabila mengajukan gugatan ulang atau lain ke pengadilan niaga atas objek benda tersebut dapat beralih bila dilakukan gugatan gugatan lain kepada pengadilan atas boedel pailit tersebut.hasil penelitian yang didapatkan dari penelitian ini bahwa peran Notaris dalam proses kepailitan ialah membuat akta terhadap pengalihan aset, membuat pengikatan akta terhadap jaminan kebendaan dan membuat akta notarial penjualan di bawah tangan dalam proses pemberesan harta pailit. Notaris dalam hal ini dapat dikenakan tidakan pidana apabila terbukti terhadap perbuatan hukum yang dilakukkannya menimbulkan kerugian bagi para kreditur. Kebaharuan penelitian sebelumnya sudah ada penelitian yang membahas penelitian ini namun, setiap penelitian memiliki karaketristik masing-masing. Penelitian ini lebih menekankan peran Notaris serta kepastian hukum akta kuasa menjual terhadap objek yang di pailitkan dan serta tanggung jawab hukum.
