Co-operative system in the agriculture in the times of globalization - chosen legal issues

Przedstawiono wybrane zagadnienia prawne poświęcone spółdzielczości, w szczególności odnoszące się do spółdzielczych grup producentów rolnych oraz spółdzielni europejskich. Wskazano na ewolucję ustawodawstwa w zakresie tworzenia i prowadzenia działalności przez grupy producentów rolnych, zwłaszcza te, które wybrały formę spółdzielni. Zaprezentowano przepisy unijne oraz polskie dotyczące spółdzielni europejskiej, która jest nową formą prawną, odrębną w stosunku do spółdzielni krajowych. Poruszona również została kwestia zmiany przepisów prawnych poświęconych spółdzielniom oraz wyodrębnienia w naszym systemie prawnym spółdzielni rolników.The paper presents the selected legal problems concerning co-operatives, particularly co-operatives of groups of agricultural producers and a European Co-operative Society. The paper also shows the evolution of the legislation in the scope of setting up and running the business activity by agricultural producers' groups, especially by those who have chosen the form of co-operatives. The EU and Polish regulations have been presented in relation with a European Co-operative Society, which is a new legal form, but separate from domestic co-operatives. This form has been created for the purposes of a typical co-operative, but has a lot of characteristic features of the companies, especially joint stock companies. The paper also outlines the issues of the changes in the legal regulations concerning co-operatives and the formation of farmers ’ co-operatives in our legal system
