The Role of the Labour Code in the Personal Values Protection of the Employment Contract Parties

According to the thesis proposed in the article the Labour code does not ensure equal level of protection for both parties to the employment contract. It evidently gives preferential treatment to the employee, for the protection of employees’ personal value is a fundamental rule of labour law. It is suggested to introduce the rule of the employer’s personal values protection as one of the de lege ferenda conclusions. It would lead to a change in the perception of the protective role of labour law as a factor ensuring protection for both parties to the employment contract.W artykule postawiono tezę, że Kodeks pracy nie zapewnia w równym stopniu ochrony dóbr osobistych obydwu stronom stosunku pracy, wyraźnie preferując w tej ochronie pracownika, wobec którego traktuje ochronę tych dóbr jako podstawową zasadę prawa pracy. W ramach wniosków de lege ferenda zaproponowano wprowadzenie do Kodeksu pracy wzajemnej zasady poszanowania ze strony pracownika dóbr osobistych pracodawcy. Pozwoliłoby to zmienić postrzeganie ochronnej funkcji prawa pracy jako służącej nie tylko pracownikom, ale także pracodawcy
