TThe council of Europe Convention on Cybercrime (November 23rd 2001) recognizes and assumes the possibility of evading criminal conduct beyond the boarders of the country where the crime was committed. The Convention proposes a functionalist theory of penal law in order to base the imposition of the sentence guaranteeing fundamentals rights. The author highlights the inadequacy of traditional systems aim at persecuting informatics crime. He considers, however, that the Convention puts cyber crime and habitual delinquency on the same footing.
