El análisis discursivo del derecho

Traditionally, literary text have been employed as judicial casuistic by juridical texts. The stories were useful as long as they had diagramed a problem of legal interpretation; nevertheless, parallel to this instrumental usage, the literary theory, and more particularly Linguistics have developed theories for text analyses which only currently are being taken into consideration by Law’s theory makers.Thus, in our times, the way seems to have been inverted, for the jurists feel evermore impelled to appeal to the extra-legal perception of Literature, Linguistics, or Philosophy in order to solve the concrete problems of their own discipline. This set of theories that have the concern for the language as their axis has been encircled under the general label of discourse-analysis and it compounds all the other disciplines, among which, of course, is Law.This article aims, among its objectives, at expounding the questions of Law Analysis as a discourse, for which, at a first instance, the philosophical and linguistical support of the discourse-analysis will be identified; then a brief analysis will be carried out over the extra-legal discourse theories applicable to Law, such as: Semiotics, Hermeneutics, and Deconstruction, in order to, finally extend a tight summary of the discourse theories elaborated from within the juridical discipline: Communicational Theory of Law, Critique and Narrative Theory of Law, and the Theory of Communicative Action, with some final remarks by the author.Tradicionalmente los textos jurídicos han empleado los textos literarios en tanto casuística judicial. Las historias servían en la medida en que diagramaban un problema de interpretación legal; sin embargo, paralelamente a este uso instrumental, la teoría literaria, y más propiamente la Lingüística, han venido desarrollando teorías para el análisis de textos que recién están siendo tomadas en cuenta por los teóricos del Derecho.Así en nuestros tiempos el camino parece haberse invertido, ya que en la actualidad los juristas cada vez se sienten más impelidos a recurrir a la percepción extralegal de la Literatura, la Lingüística o la Filosofía para solucionar los problemas concretos de su propia disciplina. A este conjunto de teorías que tienen como eje la preocupación por el lenguaje se les ha englobado bajo el rótulo general de análisis discursivo, y comprende todas las disciplinas, entre las cuales se encuentra, por supuesto, el Derecho.El presente artículo tiene entre sus objetivos plantear la cuestión del análisis del Derecho como discurso, para lo cual en una primera parte se identificará el sustento filosófico y lingüístico del análisis discursivo; a continuación se realizará un breve análisis de las teorías discursivas extralegales aplicables al Derecho como son: la Semiótica, la Hermenéutica y la Deconstrucción, para, por último, esbozar un apretado resumen de las teorías discursivas elaboradas desde la disciplina jurídica: la Teoría Comunicacional del Derecho, la Teoría Crítica y Narrativista del Derecho y la Teoría de la Acción Comunicativa, con algunas apreciaciones finales del autor
