Proses Penyidikan Tindak Pidana Jual Beli Narkotika Secara Online di Kabupaten Tulungagung(Studi Kasus di Polres Tulungagung)

The crime of buying and selling narcotics online is a deviation in Indonesia and has strict rules. This has actually been regulated in accordance with Law Number 35 of 2009 concerning Narcotics, but online transactions have no definite rules. In this legal research, the investigation process is still the same as the investigation process for the criminal act of buying and selling narcotics as in general. There are things that investigators have not been able to do, such as how difficult it is to find the origin of goods, considering that the internet is very broad in scope. The purpose of this study was to find out a series of investigators' actions in collecting evidence and determining the suspect in the crime of buying and selling narcotics online in Tulungagung Regency. The method used in this study is an empirical juridical method, namely a case study at the Tulungagung Police. The results of the study indicate that there are reports from the public regarding the reports received are very minimal so that the police are proactive, in terms of collecting evidence there is still a gap, namely in the arrest, the arrest warrant for the suspect does not include a complete identity which is a mandatory requirement according to the order of the Criminal Procedure Code. examination of a suspect by an investigator should adhere to the legal principle of presumption of innocence, which means that the suspect must be presumed innocent until a court decision declares his guilt and obtains permanent legal force. In terms of filing and submitting files, cases are still often found in which the files are still going back and forth from the public prosecutor to the investigator, which sometimes also hinders the completion of the investigation. Suggestions, the police at the Narcotics Unit at the Tulungagung Police should further improve All investigative actions must remain under control and not carry out arbitrary action
