DINAMIKA INTERPRETASI PERLINDUNGAN TERHADAP ANAK DALAM PENENTUAN BATAS USIA NIKAH DI INDONESIA: KAJIAN PUTUSAN MAHKAMAH KONSTITUSI NO. 30-74/PUU-XII/2014 DAN PUTUSAN MAHKAMAH KONSTITUSI NO. 22/PUU-XV/2017

This thesis examines the result of the Constitutional Court choice depending on the decision in 2014 and 2017 on Article 7 paragraph (1) of the 1974 Marriage Law with a maqashid sharia analysis. the Problem starting from early marriage or the age of children often get some special attention by some group. Because of the determination of the age limit for marriage, namely the age of 16 years for women is considered inappropriate and contrary to the Constitution. In fact, the Constitutional Court decided to give a choice through a complete rejection of the Petitioners' petition in option Number 30-74/PUU-XII/2014 and granting partial fulfillment of the Petitioners' petition in option Number 22/PUU-XV/2017. As a country with a majority Muslim population, the changes to the two Constitutional Court decisions are very interesting if the two Constitutional Court decisions are analyzed using maqasid sharia. The main question of this research is what the arguments and value of maqashid sharia hidden behind the two Constitutional Court decisions differ between decisions I and II. This research is normative research or library research, which is research that examined archive studies, namely subjective investigation, meaning that it focused on clarifying information related to the Constitutional Court's decision. The analysis in this research is maqashid sharia, namely looking at the text and the purpose of the law (al-Nuṣuṣ wa al-Ahkâm bi Maqashidiha), focusing on benefit and avoiding harm (Jalbu al-Mashalih wa Dar'u al-Mafasid). This research collection method used literature data about the two Constitutional Court decisions and their accompanying ones, as well as references to sharia maqasid. This investigation found that the consideration of the Constitutional Court regarding certainty as far as possible for marriage Number 30-74/PUU-XII/2014 does not conflict with the Constitution and is in accordance with religion, especially Islam. Because Islam knows no age limit and only about aqil baligh. With the determination of the age of 16 years, the Constitutional Court argued to prevent the harm of getting pregnant out of wedlock. So the age limit of 16 years is a maslahah to maintain offspring based on maqasid sharia. Meanwhile, the Constitutional Court's thoughts as far as possible regarding marriage Number 22/PUU-XV/2017 are contrary to the Constitution considering that the choice contains harmful elements. The Constitutional Court argued that everyone has equal rights before the law. So MK suggested to lawmakers to adjust as far as possible for marriages between people. Differences in the age limit for marriage have a negative impact on women such as not being able to get a decent job, getting sexual violence, being beaten, not getting a living, and miscarriage. Therefore, the equalization of the age limit for marriage is maslahah to protect the mind, property, soul, and offspring for women based on maqasid sharia. Thus, the consideration of the decision in 2017 is more problematic than the 2014 decision based on sharia maqasid
