ANALISIS YURIDIS PRESIDENSIAL THRESHOLD DALAM PEMILIHAN PRESIDEN DAN WAKIL PRESIDEN DITINJAU DARI PRINSIP KEDAULATAN RAKYAT

The Presidential Threshold or the threshold for the nomination of President and Vice President which has been regulated in Article 222 of Law No. 7 of 2017 concerning General Elections has stipulates that the requirements for the nomination of candidates for President and Vice President must meet the requirements of 20% of the seats in the DPR and 25% of the vote. legitimate nationally has sparked many pros and cons. The author formulates two problem formulations. First, how the Presidential Threshold in the election of the President and Vice President is viewed from the principle of people's sovereignty and Second, the Legal Implications of the Presidential Threshold in the election of the President and Vice President in terms of the principle of people's sovereignty. The author uses a normative juridical research method to describe the Presidential Threshold more deeply. Indonesia as a democratic country and has declared itself as a people's sovereign state which has been stated in Article 1 paragraph (2) of the 1945 Constitution of the Republic of Indonesia, based on this the author uses the theory of people's sovereignty as a knife for analyzing the application of the Presidential Threshold in Indonesia, in results of research and discussion The author concludes that the existence of a threshold for the nomination of President and Vice President is not in line with the principle of people's sovereignty which in fact this threshold eliminates the rights of Some political parties participating in the election are lost, and the people's rights to get many alternative candidates for President and Vice President are lost , this certainly weakens the sovereignty of the people which is implemented in the right to vote in general elections. The author suggests that the threshold for the nomination of President and Vice President as regulated in Article 222 of Law No. 7 of 2017 concerning General Elections is abolished as a form of strengthening democracy
