SENGKETA TANAH DESA SENDI DENGAN PERUM PERHUTANI KPH PASURUAN TAHUN 1999-2017

Land dispute in Sendi village with Perhutani KPH Pasuruan is an example of agrarian conflicts that often occur in Indonesia. That prbolems examined in this study namely : 1) How is the history of land dispute conflicts between Sendi village and Perhutahi KPH Pasuruan in 1999-2017? 2) How are the policies issued by the government to resolve land dispute conflicts between Sendi village and Perhutani KPH Pasuruan in 1999-2017? 3) How was the impact felt by the Sendi village community regarding the land dispute conflict with Perhutani KPH Pasuruan in 1999- 2017?. While the puropose of this study is 1) Describe the history of land dispute in Sendi village with Perhutani KPH Pasuruan in 1999-2017? 2) Know the policies issued by the government to resolved land dispute conflicts between Sendi village and Perhutani in 1999-2017? 3) Know the impact felt by the Sendi village community regarding the land dispute conflict with Perhutani KPH Pasuruan in 1999-2017?. This research uses historical research metohds, including : 1) Heuristic 2) Criticism 3) Interpretation 4) Historiography. The results of this study are the background of the land dispute between Sendi village and Perhutani KPH Pasuruan, starting from the history control during the Dutch colonial era the Japanese occupation. During the Dutch colonial period, Sendi village land was used as a lemon grass plantation. So that the people op Sendi village were forced to flee to the surro-unding village. After independence, the empty land in Sendi village was then controlled by the Forestry Bureau. In 1999, Perhutani carried out illegal lgging on the land in Sendi village, causing conflict between the village community and Perhutani. Perhutani claims that the land beling to him because there is Evidence of The Exchange and Compensation Award B Number 1-1931 dated 21 November 1931 and B Number 3-1932 dated 10 October 1932. The peak of the conflict was Perhutani reporting the village community in Sendi to the Mojokerto Police. The government’s effort to resolve the conflict was by coo-perating with legal officials such as the police and the Koramil, but it was deadlocked. Then, another soution issued by the government is to provide a recommendation that Sendi village be made a custmary village. The impact felt by the Sendi village community regarding the dispute was the rampant social conflict between the vilage community and Perhutani, then the level of community welfare that is less with the lack of water and lighting and educational facilities that are not supportive to advan-cing the welfare of the people of Sendi village.Keyword: land dispute, Sendi Viilage, Perhutani
