ABSTRACT Name : Ilham Dwi Handhoko NIM : 201710110311246 Title : Law Enforcement Against Bullying Behavior in Sugihwaras Elementary School 07 Kab. Madiun (Case Study Sdn. Sugihwaras 07 Kab. Madiun and Madiun Resort Police). Adviser : 1. Dr.Tongat, S.H.,M.Hum. 2. Cholidah, S.H.,MH Bullying is not only common in big cities but also in small towns. For example, elementary schools in Madiun Regency found cases of bullying where the perpetrators were still in elementary school. In the case of bullying, the bullying found included physical, verbal and non-verbal bullying. When viewed from the legal regulations of the Criminal Code, forms of bullying are included in a criminal act according to Article 351 of Persecution, Article 368 of Extortion, Article 369 of Threats, Article 335 of Unpleasant Acts and Article 310 of Defamation. Based on acts of bullying that occurred within the school scope Sdn. Sugihwaras 07 saw the perpetrators of children who were still 12 years old and did not include repeating crimes and arising from the actions of the perpetrators that did not result in physical disability or death and the victim was still 12 years old, the perpetrator could not be prosecuted impose sanctions according to the Criminal Code but refers to Law Number 35 of 2014 Amendments to Law Number 23 of 2002 concerning Child Protection and Law No. 11 of 2012 Child Criminal Justice System. In law enforcement, perpetrators can be subject to action sanctions in Article 62 paragraph (2) of Law No. 11 of 2012 the Juvenile Criminal Justice System and in its settlement, prioritizing the diversion route referring to the contents of Article 7 of Law No. 11 of 2012 concerning the Judicial System.
