TINDAK PIDANA PENIPUAN DAN PENGGELAPAN INVESTASI BIT KINGDOM (Analisis Putusan 2506/Pid/B/2019/PN Mdn)

This research examines the crime of fraud and investment embezzlement of Bit Kingdom (Analysis of Decision 2506/Pid/B/2019/PN Mdn). The purpose of this study is to analyze the fulfillment of the elements of fraud and embezzlement of investment capital in the Medan District Court's decision with case number register 2506/PID.B/2019/PN.Mdn. The research method used is a normative juridical approach, which is an approach that seeks to synchronize the applicable legal provisions in legal protection against other legal norms or regulations with their relation to the application of these legal regulations in practice in the field. The results of this study are that the First Level Panel of Judges considers the demands of the first indictment, namely the provisions of Article 378 of the Criminal Code is a claim that meets the criminal element committed by the defendant, while the demands of the second indictment, namely Article 372 of the Criminal Code, are considered by the Medan District Court Judges to not fulfill the criminal element of embezzlement. The criminal element of embezzlement in an investment crime should be said to have been fulfilled by the defendant. Keywords: elements of crime, embezzlement, fraud, investment.
