UNSUR TINDAK PIDANA DALAM KASUS PENIPUAN/PENGGELAPAN BERDALIH INVESTASI (Analisis Putusan Nomor 97/Pid.B/2019/PN.Bdg)

In the era of globalization, the development of economic and micro-businesses in Indonesia has moved into the long-term sphere through futures investment offerings. Unfortunately, the development of economic and micro-businesses whose scope of investment has not been accompanied by the conception of legal certainty, so this becomes a weak point in the legal protection of investments made. Basically, the practice of investment is based on civil values through an agreement / alliance, but legal cases that occur in Indonesia in relation to the implementation of investments more leads to criminal cases because in the investment process there is an element of criminal deception / embezzlement of investment funds. This study aims to provide a juridical review of the element of criminal deception in investment law cases using the legal instruments of court rulings. The research method used in this study is literature study with descriptive analytical analysis method, to see the application of the law in the court ruling referred to by looking at the association between the conception of civil values and elements of criminal deception contained in the raised legal case. Based on this, the initial conclusions that can be drawn by the author of the judge have been appropriate in determining the elements of criminal deception in the case of investment law and putting aside the civil values contained therein.Keywords: elements of crime, deception, and investmen
