Controversies on Nature as universal Legality (1680-1710)

The article "Controversies on Nature as Legality (1680-1710)" is a first complement to the article "Les lois de la nature : le problème terminologique", for in it I examine the texts of which what I called the physico-mathematical and the metaphysical usages of the word "law" meet. These texts can be divided into two constellations. The first corresponds to the polemic between Antoine Arnauld and Nicolas Malebranche, in which intervened Bernard Le Bovier de Fontenelle, Pierre Bayle, Jacques-Bénigne Bossuet and François de Salignac de la Motte-Fénelon (1685-1715). The second constellation is made up of the exchanges between Leibniz, Bayle, Jean Christophe Sturm and Gunther Christoph Schelhammer (1695-1707). If the notion of law of Nature is omnipresent in these texts, it is because it allows us to question the relations between three terms -- the things of our world, a Nature defined in terms of universal legality, and God, creator, lawgiver and guarantor of a particular providence. I deal successively with three general questions, the second and third are themselves divided into two sub-questions. The first question is that of the modality of the laws of nature: are they necessary, arbitrary or contingent? The second question is that of the universality of the laws of nature: is the Malebranchist principle of the simplicity of the ways 1) metaphysically satisfying? 2) reconcilable with the notion of particular Providence? The third question is that of the efficacy of the laws of Nature: 1) what is the relation, a parte Dei, between law, will and power? 2) what must be expected from creatures so that they can be able to respect the laws of Nature? The existence of different responses to these questions at the end of the 17th century demonstrates that the generalization of the expression "law of Nature" in the sciences was not accompanied by a consensus on what characterized a law of Nature. One can on the contrary make the hypothesis that one of the reasons for the historic success of this expression comes from its latitude -- from its capacity to cover varying ontological commitments. These philosophical questions are crucial. Moreover, this paper shows that the generalisation of the expression "law of Nature" in the sciences has not been followed by a consensus on what characterized a law of Nature. On the contrary, it is suggested that one of the reason of the historical success of this expression is its capacity to mask different metaphysical and scientific commitments.L'article " Controversies on Legality (1680-1710) " est un premier complément de l'article " Les lois de la nature : le problème terminologique ", puisqu'il examine les textes où ce qui avait été appelé l'usage physico-mathématique et l'usage métaphysique du mot " loi " se rencontrent. Ces textes s'ordonnent en deux constellations. La première correspond à la polémique d'Antoine Arnauld et de Nicolas Malebranche, où interviennent Bernard Le Bovier de Fontenelle, Pierre Bayle, Jacques-Bénigne Bossuet et François de Salignac de la Motte-Fénelon (1685-1715). La deuxième constellation est constituée par des échanges de Leibniz, Bayle, Jean Christophe Sturm et Gunther Christoph Schelhammer (1695-1707). Si la notion de loi de la nature est omniprésente dans ces textes, c'est qu'elle permet d'interroger les rapports entre trois termes -- les choses de notre monde, une nature définie en termes de légalité universelle, et Dieu, tout à la fois créateur, législateur et garant d'une providence particulière. Trois questions générales y sont successivement abordées, la deuxième et la troisième se décomposant elles-mêmes en deux sous-questions. 1. La première question est celle de la modalité des lois de la nature : sont-elles nécessaires, arbitraires ou contingentes ? 2. La deuxième question est celle de l'universalité des lois de la nature : le principe malebranchiste de la simplicité des voies est-il 1) métaphysiquement satisfaisant ? 2) conciliable avec la notion de providence particulière ? 3. La troisième question est celle de l'efficacité des lois de la nature : 1) quel est le rapport, a parte Dei, entre loi, volonté et puissance ? 2) que doit-on supposer du côté des créatures pour qu'elles soient en mesure de respecter les lois de la nature ? Par delà l'intérêt que présentent ces questions philosophiques, l'existence de différentes réponses à la fin du XVIIe siècle montre que la généralisation de l'expression " loi de la nature " dans les sciences n'a pas été accompagnée d'un consensus sur ce qui pouvait caractériser une loi de la nature. On peut au contraire faire l'hypothèse qu'une des raisons du succès historique de cette expression vient de la capacité qu'elle avait à masquer des différences d'engagements métaphysiques et scientifiques
