Natural law and the judicial abstraction. Some hypotheses on the nature of medieval law. The opposition between natural law and positive law, which is crucial to maintaining the distinction between fact and law that underpins any juridical action, was first constructed in the medieval West during the 12th century. Against a historiography that celebrates the naturalism of medieval law, this article demonstrates that it is precisely positive law which constitutes the marked term in the opposition "natural" versus "positive" law. It does so through a close study of the lexical and conceptual formation of this opposition in the work of Pierre Abélard and Thierry de Chartres.
