Tanggung Jawab Hukum Terhadap Pelaksanaan Jual Beli Online Atas Barang Kosmetik

At this time many people prefer to carry out buying and selling activities online because it has several advantages, one of which is saving more time. Buyers do not have to come to the store, but can make purchases from home through e-commerce applications. However, buying goods online also has some disadvantages, such as the buyer cannot see the item you want to buy directly, the buyer can only see the item to be purchased through the photo shown by the seller. Cosmetics until now have become a basic necessity that everyone must meet, even now, not only women who use cosmetic products, there are several cosmetic products made specifically for men, such as masks and face creams. This study aims to determine the agreement process in online buying and selling of cosmetic items, knowing the rights and obligations as well as regulations in online buying and selling of cosmetic items, and knowing the legal responsibility if one of the parties commits a violation in the online trading of cosmetic items. This type of research used in this research is descriptive research, which systematically explains the legal responsibility for the implementation of online buying and selling of cosmetic items. The approach used is a normative approach that examines legal aspects, legal rules regarding legal responsibility for the implementation of online buying and selling of cosmetic items. Based on the results of the study, it shows that in the process of buying and selling online for cosmetic goods, the buyer must meet administrative and legal requirements. Administrative requirements include: Fill in the order format and attach proof of payment transfer. The legal requirements are the legal terms of the agreement contained in Article 1320 of the Civil Code. The agreement occurs when the order format has been filled in by the buyer, after the buyer sends the completed order format along with proof of payment, the buyer has agreed with the agreement made by the seller. After an agreement is made by the parties, it will then lead to a legal relationship which will then give birth to binding rights and obligations for both the buyer and the seller as referred to in Article 1338 of the Civil Code. If one of the parties is deemed to have committed default as stated in Article 1243 of the Civil Code or an act against the law as stated in Article 1365 of the Civil Code, it can be prosecuted to the District Court
