La mutación de la Unión Europea y de su derecho originario: la modificación del artículo 136 del TFUE, y otros tratados (tratados parásitos) suscritos por estados de la Unión Europea, en particular el tratado de estabilidad, coordinación y gobernanza en la Unión Europea

This paper discusses the reform of Article 136 of the Treaty on the Functioning of the European Union, the Treaty establishing the European Stability Mechanism (ESM), the Framework Agreement on the European Financial Stability Facility (EFSF) and the Treaty on Stability, Coordination and Governance in Economic and Monetary Union and the aforementioned relations with the EU Treaties. The analysis of these relations it follows that although the ESM, the EFSF and the Treaty of Stability create organizations outside the European Union maintain very close relations with the EU institutions and their right to the point that they can be referred parasites Treaties and organizations of the European Union. The paper analyzes the causes of this new generation of treaties that holds inaugurate a new phase of European integration, which is far from the metaphor of a Europe of two speeds, and that can be represented as a system of concentric circles. The concentric circle or core includes all States of the Union and is governed by Union law. And from the other eccentric circle overlap, each governed by Union law and other treaties governed by euro-governmental nature or a combination of EU law and European intergovernmental treaties.En este trabajo se analizan la reforma del artículo 136 del Tratado de Funcionamiento de la Unión Europea, el Tratado Constitutivo del Mecanismo Europeo de Estabilidad (MEDE), el Acuerdo Marco sobre la Facilidad Europea de Estabilización Financiera (FEEF) y el Tratado de Estabilidad, Coordinación y Gobernanza en la Unión Económica y Monetaria, así como las relaciones de los mencionados Tratados con la Unión Europea. Del análisis de dichas relaciones se deduce que aunque el MEDE, el FEEF y el Tratado de Estabilidad crean organizaciones al margen de la Unión Europea mantienen relaciones muy estrechas con las Instituciones de la Unión y su Derecho hasta el punto de que se les puede denominar Tratados y organizaciones parásitos de la Unión Europea. En el trabajo se analizan las causas de esta nueva generación de tratados que se sostiene inauguran una nueva etapa de la construcción europea, que se aleja de la metáfora de la Europa de las dos velocidades, y que se puede representar como un sistema de círculos concéntricos. El circulo más concéntrico o núcleo incluye a todos los Estados de la Unión y se rige por el Derecho de la Unión.
