KENDALA PENYIDIK DALAM PENERAPAN PERATURAN MAHKAMAH AGUNG NOMOR 2 TAHUN 2012 TENTANG PENYESUAIAN BATASAN TINDAK PIDANA RINGAN DAN JUMLAH DENDA DALAM KUHP (STUDI KASUS POLRESTA MALANG KOTA)

ABSTRACTIn the law enforcement process that is based on criminal law and criminal procedural law, which refers to the Criminal Code which regulates more clearly criminal acts ranging from minor crimes to crimes in the serious category, namely the Criminal Code which is the guideline for criminal law will experience changes in accordance with the motive -Motive of the current criminal act. From the background, the author raises the problem, namely, how is the application of Supreme Court regulation number 2 of 2012 concerning adjustments to the limits of minor crimes and the amount of fines in the Criminal Code against the investigation process. as well as the impact of the issuance of Supreme Court regulation number 2 of 2012 concerning adjustments to the limits of minor crimes and the amount of fines in the Criminal Code against investigators and victims. This type of research used in the writing of this research is descriptive. The type of approach the writer uses is an empirical juridical approach.Keywords: Investigation, Tipiring, PermaABSTRAKDalam proses penegakan hukum yang berpatokan pada hukum pidana dan hukum acara pidana, yang mengacu pada KUHP yang mengatur lebih jelas mengenai tindak pidana mulai dari tindak pidana ringan hingga tindak pidana dalam kategori berat, yakni KUHP yang menjadi pedoman hukum pidana akan mengalami perubahan sesuai dengan motif-motif tindak pidana yang ada dimasa yang sekarang. Dari latar belakang penulis mengangkat permasalahan yaitu, bagaimana penerapan peraturan mahkamah agung nomor 2 tahun 2012 tentang penyesuaian batasan tindak pidana ringan dan jumlah denda dalam kuhp terhadap proses penyidikan. serta bagaimana dampak dari lahirnya peraturan mahkamah agung nomor 2 tahun 2012 tentang penyesuaian batasan tindak pidana ringan dan jumlah denda dalam kuhp terhadap penyidik dan korban. Jenis penelitian yang dipakai dalam penulisan terhadap penelitian ini ialah bersifat deskriptif.
