ANALISIS PENAHANAN IJAZAH ASLI KARYAWAN SEBAGAI JAMINAN DALAM HUBUNGAN KERJA DALAM PERSPEKTIF HUKUM(STUDI DI PT ADIRA MULTI FINANCE TBK CABANG BARITO UTARA KALIMATAN TENGAH)

In the world of work in Indonesia, workers are needed to carry out all activities in the company, but because of the large number of prospective workers and the increasing interest in working for prospective employees in Indonesia, it is not proportional to the number of jobs provided. The company also took the initiative to withhold employees 'original certificates as job security on the basis of avoiding fraud from employees because the company does not want to be harmed by employee behavior, therefore the company PT Adira Multi Finance, the North Barito branch, in its work agreement includes a clause on the detention of employees' original certificates. This study uses the Sociological Juridical method by identifying and conceptualizing Law as a real and functional social institution in real life. This study aims to systematically describe an event and facts that occurred at PT Adira Multi Finance, North Barito branch, the author also conducted observations and documentation and interviews with several employees. With this the authors conclude that the work agreement containing the clause on the retention of the employee's original certificate is not based on law because there are no laws and regulations and is not listed in company regulations. Therefore it is necessary to renew the Manpower Act and also the work regulations so as not to harm the employees
