The Mexican panel recommends only "the acceleration of the works" in Mexico. As recent as May 10, 1962, in a letter to Senator Carl Hayden from the State Department it was stated, ".... the Mexican government does not plan to submit the plan to the International Bank for consideration until a solution to the salinity problem is found." It appears that Mexico may not be willing to proceed at the same pace which is being urged upon the United States. The report of the Joint Panel makes no reference to such questions as the reimbursability of costs or the effect of the proposed works and the operation thereof on the interests of the Wellton-Mohawk Project. Nor does it extend to any consideration of the effect of the recommended program on other upstream interests within the Basin. 3. Careful study of the report and the recommendations submitted leads to the most certain conclusion that the proposal submitted is both sketchy and incomplete, In our opinion, the report falls far short of presenting a reasonable basis for solution or settlement of this complicated problem - one which looms as highly important to the future welfare of Arizona and all other States in the Colorado River Basin. This is no reflection upon the ability of members of the Panel or others who have so diligently pursued study of the problem over the past 45 days. The clear fact is that these men have not had sufficient time to obtain, study and evaluate all of the facts. I believe that those close to the problem will support this conclusion. 4. Arizona is convinced that recommended solution by the Panel raises very grave legal problems, both internationally and domestically. These problems would have to be resolved favorably before such a proposal could be given consideration. They are inseparable from the adoption of any plan of facility construction. In the international field there would be a departure from the treaty with Mexico. Water from the United States would be bypassed at Morelos Dam and would not be chargeable to the Treaty. This might set a precedent for similar treatment of return flow from other projects, in the United States, constructed or planned for the future. In the United States an equally grave problem is raised by the Panel's recommendation. Litigation between four states of the Basin began some ten years ago. It is in its final stage, and we hope a decision by the United States Supreme Court will be made soon.
