Forcing the States to use these alternative costs, rather than pursue joint support of our Plan, is completely impracticable. The Central Arizona Project could not be undertaken with $110 per acre-foot water. Also, the Imperial and Coachella Valleys of California could not exist on $75 or more water. To implement the treaty with Mexico dividing the waters of the Rio Grande, the Federal government in cooperation with Mexico has constructed the Falcon dam and reservoir and is now constructing Amistad dam and reservoir. These structures will control the waters of the Rio Grande and will be of extreme value in maintaining the existing irrigation economy dependent on the Rio Grande at no cost whatsoever to the water users. c. Water Export Guarantee. If 1.2 million acre-feet of water is developed and conveyed South from Northern California as a part, in effect, of making water available in the Colorado River, then a maximum of some 500,000 acre-feet can be said to be exported by exchange from California to Arizona and Nevada. This is derived by prorating the 1.2 million acre-feet in the same ratio as State entitlements to Colorado River water. Why should a State ask the Federal government to guarantee to it that its future internal water use shall not be more expensive by reason of exporting water? If one took the position, under some Constitutional theory, that the water in a State belongs to all the people of the United States, then clearly there is no reason for such guarantee. But North Coastal California water is viewed by California as its water. And I know of no Federal official today who would be willing to assert otherwise. The matter of Federal versus State water rights is an extremely volatile political issue in the West. Moreover, within a State regions and areas take the position that "their water is theirs." In the case of California, the "county of origins doctrine is established in law. In effect, Southern California is not to get water from Northern California in such a way as to make the latter's water more expensive than it would have been without export to Southern California.
