FIFTH STAGE - SEPTEMBER 12 -, 1964 1. United States Response United States cannot accept proposed "by-pass" of 90,000 acre-feet of waters, which would require releases from storage. 2. Possible Compromise Discussions developed that agreement might be reached upon the "by-pass" alternative - 1.5 salt balance, on the basis of : a) Mexico would request treaty minimum flows for total of 102 days - three winter months - Oct., Nov., and Dec., and 10 days in January. b) United States would by-pass excess flows during same three months, which would amount to approximately 61,000 acre-feet. c) Mexico could by-pass a part of its waters on request. d) Pumping operations would be conducted insofar as practicable to minimize peak salinities by pump selection and reduction. 3. Discussion a) Questions: 1) Can U. S. operate "by-pass" for 90 days and obtain 1.5 salt balance, without release of waters from storage; 2) What will be the resulting probable monthly average and maximum salinities? This question was referred to the Bureau about September 15, 1964. 3) Will Mexico accept the solution, understanding the approximate resulting salinities. b) Note: This solution would be applicable to U. S. without loss of water only as long as excess waters are available for by-pass. 4. Conclusion The proposed "102-day by-pass, 1.5 salt balance" might offer a basis for solution - subject to the findings of the Department of the Interior.
