PENGARUH PELAKSANAAN TINDAKAN KEIMIGRISIAN OLEH DIREKTORAT JENDERAL IMIGRASI TERHADAP PELANGGARAN IZIN TINGGAL YANG DILAKUKAN ORANG ASING DI WILAYAH DKI JAKARTA

Jakarta is famous as the capital city of the States of Indonesia Republic. All of things are present in the central of this States and various accesses are easy and fast to be achieved. The main factors caused a lot of people migrate to Jakarta has purpose to work or have business. It is not only the inhabitant if Indonesia States, the foreign people also feel attracted to visit to Jakarta by the. variation purposes, i.e. willingness to stay alive, having business and work. Moreover, any of them would like to stay in the region of Jakarta. Certainly it brings any positive impact because it could increase the States's device. However, in the fact there are a lot of violations that happened where the foreigner emerge any negative impacts. The result, it could harm the peace and order which is not appropriate to the Pancasila and Undang-Undang Dasar 1945. The problems which often happen nowadays based on the General Directorate of Immigration is the case of license trespassing to live, where these foreigners conduct the activity which is not appropriate to the purpose and aim of granting the immigration. This legal writing concern about how is the impact of the action of immigration, the barriers should be faced, and the efforts are conducted by the General Directorate of Immigration toward the trespassing of license to life which is done by the foreigners in the region of Capital City Jakarta in 2003 until 2006. This research was empirical legal research, because it focused on legal community's behaviour by the purpose to get the legal act. Legal fact which happened in 2003 until 2005 stated that the action of immigration which was done by the General Directorate of Immigration has no effect, because it has been proven the increasing of incident to trespass and there was increasing on the foreigners's visit. However in 2006, the legal fact which happened stated that the immigration action which has been conducted by the General Directorate of Immigration has any impact. It was proven from the decreasing incident of the trespassing amount. However the amount of foreigners visiting to Jakarta even becomes more increased. To maintain in order the amount of trespassing not to increase anymore, these it needs the medium and prerequisites in the controlling system of foreigners. It needs the providing of Detention House of Immigration in every Immigration Office and adds the Detention Room of Immigration which is posited in the area of Laws and Human Rights Department, it needs the increasing of technical immigration officials, and the necessities to revise the Law on Immigration, especially in giving any proofs
