ANALISIS YURIDIS PUTUSAN MAHKAMAH KONSTITUSI NOMOR 18/PUU-XVII/2019 TENTANG EKSEKUSI JAMINAN FIDUSIA TERHADAP DEBITUR WANPRESTASI DI INDONESIA

AbstractExecution of fiduciary executions based on the norms of article 15 paragraph (2) and (3) of Law No. 42 year 1999 on fiduciary guarantee turns out to be polemic and does not provide legal balance between the parties. Therefore, the Constitutional Court issued an award No. 18/PUU-XVII/2019 to give interpretation of the norm of article a quo. Therefore, do you need to know what ratio of the decidents to the Constitutional court in the ruling?, and how the execution mechanism of fiduciary guarantee after the verdict?. This research is normative juridical research, with a perundangan-undangan and conceptual regulatory approach. Based on this research it can be concluded that the Constitutional Court in the ruling, has given the interpretation of article a quo, hence the execution of fiduciary executions executed under Law No. 42 year 1999 on fiduciary guarantee and article 196 HIR or article 208 RBg.Keywoards: Decision of the Constitutional Court, Fiduciary, Default.AbstrakPelaksanaan eksekusi jaminan fidusia yang didasarkan pada norma Pasal 15 ayat (2) dan (3) Undang-Undang Nomor 42 Tahun 1999 tentang Jaminan Fidusia ternyata menimbulkan polemik dan tidak memberikan keseimbangan hukum antara para pihak. Maka dari itu, Mahkamah Konstitusi mengeluarkan Putusan Nomor 18/PUU-XVII/2019 untuk memberikan tafsir terhadap norma Pasal a quo. Oleh karena itu, perlu diketahui apa ratio decidendi Mahkamah Konstitusi dalam Putusan tersebut?, dan bagaimana mekanisme eksekusi jaminan fidusia sesudah Putusan tersebut?. Penelitian ini adalah penelitian yuridis normatif, dengan pendekatan peraturan perundangan-undangan dan konseptual. Berdasarkan penelitian ini dapat disimpulkan bahwa Mahkamah Konstitusi dalam Putusan tersebut, telah memberikan tafsir terhadap Pasal a quo, maka dari itu pelaksanaan eksekusi jaminan fidusia dilaksanakan berdasarkan Undang-Undang Nomor 42 Tahun 1999 tentang Jaminan Fidusia dan Pasal 196 HIR atau Pasal 208 RBg.Kata Kunci: Putusan Mahkamah Konstitusi, Fidusia, Wanprestasi
